Plaintiff tripped and fell over theater rope used to cordon customers waiting for service in a restaurant. Plaintiff’s own photos of the rope taken following the incident were used in her deposition to obtain confirmation that the rope could be seen. The court ruled the rope was open and obvious and therefor no duty was owed to the plaintiff.
