McCollum Crowley Attorney Obtains Dismissal of School Discrimination Claim

Earlier this year, a private-school student sued her graduate school alleging race- and sex-based discrimination and negligence for events that happened to her during a practicum at a third-party site. On behalf of the school, McCollum Crowley attorney Cheryl Hood Langel moved to dismiss the action on the pleadings. The district court granted the motion, dismissing all claims against the school-based procedurally on statute-of-limitations grounds and substantively on legal grounds—the school was not a place of public accommodations and negligence claims are preempted by the MHRA.
