Plaintiff brought a claim for injuries sustained when the custom rifle he was using for the first time backfired in his face. Plaintiff sued defendant, a gunsmith and licensed dealer, who customized the rifle and the defendant’s insurer who issued a homeowner’s policy to the defendant. Defendant gunsmith asserted that the work was not completed as a part of his business. Summary judgment was granted finding that both the Business and Professional Services exclusions applied. On appeal, the Court of Appeals affirmed the dismissal holding that the “Professional Services” exclusion precluded coverage.
